“HCS Survey Expectations 2021: Administrative Penalties & Ameliorations”

HHSC will begin handing out administrative penalties as of January 1st, 2021 associated with citations received for being out of compliance with Texas Administrative Codes & CMS (Medicaid) for the Home & Community-Based Waiver. In particular, “Critical” citations (Formally known as “Serious” citations) will have definite penalties for the HCS provider to pay, whether or not they have been corrected. The cost may be less if corrected of course, but the fees are still dependent on the “Scope & Severity” chart used by the surveyors. in any case, the provider could get saddled with some serious daily penalties until correction has occurred and been accepted or until an amelioration plan has been accepted by WS&C at HHSC. Our goal today is to review these changes and maybe discuss some ideas to prevent penalties and ways to follow up adequately and effectively if the provider does receive administrative penalties.
